Assembly Vacancies Under Statutory Determination (Awaiting ECI Notification)
Constitutional & Legal Framework for Assembly By-Elections
Section 151A, RPA 1951
Mandates that by-elections to fill casual vacancies in Parliament and State Legislatures must be held within six months from the date of occurrence of the vacancy, unless the remainder of the member’s term is less than one year.
Article 191(2) & 10th Schedule
Disqualification of a member of the Legislative Assembly on grounds of defection if the member voluntarily gives up membership of the political party under whose banner they were elected.
Article 190(3)(b)
Provides that if a member of the Legislature of a State resigns their seat by writing addressed to the Speaker and the resignation is accepted, their seat shall thereupon become vacant.
Section 70, RPA 1951
Governs candidate election to more than one seat in an assembly. The candidate must opt for one seat within the prescribed statutory period, whereupon the other seat automatically falls vacant.
Article 101(2)
Bars simultaneous membership in both Parliament and a State Legislative Assembly. If an elected MLA assumes office as an MP, the state assembly seat automatically becomes vacant.
